11th Circuit Court begins with volatile and
connected cases Edgefielddaily.com web posted May 2, 2005 The Edgefield County Court of Common Pleas opens today in Edgefield at the county court house. Among the many cases two spark community attention. In the Motion hearings at 10:00 am is the Town of Edgefield v. Dr. Walter W Mims Jr. which involves several motions on the part of the Mr. Mims and the town. The suit surrounds the condemnation and seizure of private property without public notice and other constitutional grounds concerning property owned by the Mims family in which developer Bettis Rainsford sought to convert into a theater. Mims would not sell the property so the Town of Edgefield stepped in to seize the property to convert it according to plans by Rainsford. Among the motions filed by lawyers for the Mr. Mims include a motion for summary judgment and a judgment on pleading. The second case being heard on motions is Roy Blackwell v The Edgefield County Council. As Edgefield Daily.com reported Blackwell, acting as his own attorney, has sought to dismiss the motion for an injunction and seeks to have the original suit heard before the Circuit Court Judge Marc H. Westbrook. This suit surrounds a vote by the Edgefield County Council to agree to provide financial support to the theater project proposed by Mr. Rainsford. Rainsford, who was added the day of the council meeting sought, and received a vote to provide financial support in which Blackwell states circumvented South Carolina state law. The Edgefield County Attorney John F. Byrd contends the council simply voted on a resolution to support the theater project and claims it falls well within the bounds of state law. Blackwell, however, contends resolutions do not supply county funds and simply acknowledge a support of a measure. “Once funds are brought into the mix, a whole new set of laws kick in,“ Blackwell said.
