Planned Development ordinance fails to pass, sent back to planning
commission

COUNTY – The Edgefield County Council saw the
passage of a final reading of a “Planned Development” ordinance fall to
the wayside Tuesday night when a final reading was presented for a
vote. The ordinance that passed twice on majority votes, at least one
unanimously, failed to garner any support in its final passage.
The ordinance, developed on the premise of Planned (Unit or Urban)
Development, would allow for non-conforming development in the
Merriwether area in spite of current zoning classifications imposed by
the county council in 2000.
Planning Commission Vice Chairman Roger Timpson spoke on the ordinance
and suggested that without the ordinance one a “commercial” change was
granted by the county council that the person applying for the zoning
change could do “anything” he or she wanted with the property,
including “sexually oriented businesses”.
Merriwether County Councilwoman Genia Blackwell questioned that claim
by asking that current zoning prevented such businesses from locating
in the community.
Timpson claimed that once the zoning change was approved the county
would be unable to stop the property owner from changing his or her
initial plans and do whatever they wanted.
However, under the current zoning laws in place, Sexually Oriented
Businesses (SOB’s) would not be allowed in the area in Merriwether
restricted by residential only development.
Mrs. Blackwell contended that regardless of the Planned Development
ordinance that any changes would have to come before the county council
for approval and could be rejected. She stated she had faith in the
Planning Commission that they would not advance a request for such
businesses to the council for a variance.
After very little discussion the ordinance failed to receive a motion
for passage.
As such, the ordinance dies and must return to the Planning Commission
and the process must start over in order to get the measure passed. A
process that is expected to take at least six months.
