Hall sentence will not be reviewed
web
posted June 25, 2008
COLUMBIA – Despite an uproar over the
two-year sentence of home detention for former law officer and court
bailiff Dwight Hall in the killing of Gregory Jones in 2006, a
spokesman for the SC Attorney General’s office said Tuesday they will
not be seeking a motion to reconsider the sentence. "That discussion
has been withdrawn," said Mark Plowden of the Attorney General's
office.
"There is no motion, nor do we have plans to file any (motion to
reconsider the sentence),” Mr. Plowden said. “Every prosecutor knows
that sentencing is at the discretion of the judge. There's not a whole
lot of room for Monday morning quarterbacking on it.”
Plowden said there was some discussion of a possible motion immediately
following the decision, “but that discussion has been withdrawn.”
Circuit Court Judge J. Cordell Maddox handed down a sentence of 10
years after Hall pled guilty to
manslaughter last week, but the
sentence was suspended to two years of home detention. Mr. Jones’
family has openly criticized the sentence as too light and expected Mr.
Hall to serve time behind bars, not home. Lagretta Hill, daughter of
Greg Jones, told WRDW News 12, "When somebody murders someone, they
should get 30 years to live in prison.”
Two years incarceration is the minimum sentence allowed by law with a
maximum penalty of 30 years.
Mr. Hall will also be monitored electronically during his home arrest.
