Charged: Hilliard served with murder warrant in deadly fight

EDGEFIELD – A formal
murder warrant was
issued and served Monday afternoon on Thomas Patrick Hilliard, 27,
(left) of
Johnston, in the death of 30-year-old Phil H. Herring lll. Mr. Herring
suffered a severe head wound after reportedly falling backwards
striking his head on the pavement after being struck by Mr. Hilliard in
a fight. Edgefield Coroner Thurmond Burnett confirmed the cause of
death was the head trauma.
An autopsy has been scheduled in Newberry and a formal report will not
be available until next week.
Mr. Hilliard remains in custody at the Edgefield County Detention
Center and is expected to have a bond hearing before Circuit Judge
William Keesley on Tuesday on the murder charge.
Rumors began to surface that the investigation into the case was flawed
from the beginning and that no crime scene photos were taken. Johnston
Police Chief Chris Aston said he heard the rumors and had a quick
answer. “We’ve got photos”. Chief Aston said a number of photos were
taken after the scene was cleared of people.
“We may go back and chart it (the scene) if the Solicitor wants us to,”
Chief Aston said. “Charting” is a term where measurements are taken
from various reference points in relation as to where the victim was
found and where others were present at the time the crime took place.
“There were no weapons involved so that reduced the number of pictures
needed,” Aston said.
The investigation is still ongoing Chief Aston said. “We’re trying to
get in touch with some of the people registered at the motel when it
happened,” but that is difficult he said because a lot of people do not
use their real names so finding them to get a statement as to what, if
anything, they heard or saw is a daunting task.
Additional statements and interviews are being sought from the
witnesses that were known to be on the scene. Some family members of
Mr. Hilliard have expressed they did not feel a murder charge was
proper in the case.
This is the first reported murder in Edgefield County this year. After
nearly a decade of no reported murders, Edgefield County has averaged
at least one murder a year since 2005.
