Singletary lawsuit transferred to Federal Court

EDGEFIELD – The $1 billion lawsuit brought
by William Singletary has now been sought to be moved into Federal
Court according to court papers filed by the attorney for the Edgefield
County Sheriff’s Office, Chapman, Harter & Groves law firm in
Greenville. The “Notice of Removal” from the local court district was
filed on April 22, 2009.
The filing asserts, “That the District Court of the United States has
original jurisdiction of this action by virtue of the fact that one or
more federal claims are asserted.” The claims of civil rights
violations are federal offences and as such should be heard in Federal
Court.
A check of records at the Edgefield County Clerk of Court’s Office on
Tuesday found the case has been removed from the local docket. Clerk of
Court Shirley Newby said that matter has been transferred to the US
District Court.
Mr. Singletary said Tuesday that he was not aware the case had been
transferred, but was not surprised. “The only reason why they moved it
is to try to get it dismissed quickly.” Singletary said the state court
system moves a lot slower.
“My wish is,” Singletary said, “If I’m such a liar, I wish everyone
would have their lawyers push me to go to court so they could make a
fool out of me on the stand.”
Questions have now begun to surface on the “Legal defense fund” started
by Mr. Singletary to help pay for his legal costs. According to South
Carolina state law, a person or organization seeking charitable
donations has to file with the Secretary of State. The most recent
check showed Mr. Singletary has not filed under such a designation.
However, a “legal defense fund” is not mentioned in the statutes
although a cursory review of the code prohibits a person from starting
a charity that names themselves as the beneficiary of the donations.
EdgefieldDaily.com is seeking a legal opinion on the matter.
Until such time, the address of the fund is being removed from a
previous report.
Mr. Singletary said that he “allegedly” has received a donation, but he
has not opened the envelope yet. He states it was addressed to the
defense fund so he assumes it is a donation and he is in contact with
an attorney in Greenwood that he is hoping will take his case.
Later in the interview Singletary stated he had eleven such envelopes,
none of which he has opened nor has he made any deposits into the bank
account.
All earlier plaintiffs in the case have filed answers denying the
accusations.
