Armed robber gets 4-years in plea agreement

EDGEFIELD – David Ronney Smith, 50, of Greenwood, was in General Sessions Court Tuesday where he was facing charges of burglary in the first degree, possession of a weapon during the commission of a violent crime, and illegal possession of a pistol from a January 8, 2009 burglary. Rather than risk going to trial, Mr. Smith opted for a plea negotiation and stood before Circuit Court Judge William P. Keesley for sentencing.

Assistant Solicitor Ervin Maye read off the case against Mr. Smith during the hearing which included that Mr. Smith entered a home on the 1300 block of Sweetwater Road at around 11:30 am on January 8, 2009, when he was confronted by the owner who had been asleep in an upstairs bedroom. It was then Mr. Smith pulled a pistol and pointed it at the owner and then fled the scene on a white F-150 Ford 4x4 pickup truck. The tag of the truck, Solicitor Maye said, “was bent up so you could not read the license plate number.”

Mr. Smith was located by deputies just minutes after the reported burglary and they found the tag of the F-150 pickup showed the crease where the tag was bent upward and a silver .38 caliber handgun matching the description given by the victim who later picked Mr. Smith out of a lineup.

Standing to the side of Mr. Smith in the courtroom was his wife and daughter and a family friend, Jerry Hawkins, spoke of the outstanding qualities of Mr. Smith and said that Smith and his wife were scheduled to leave for a mission trip to Kenya in two weeks. Mr. Hawkins said Mr. Smith had donated large amounts of money and time in an effort to make the mission trip possible.

Before sentencing Judge Keesley asked Mr. Smith if he had anything to say. “Yes your honor,” Smith replied,” I just want to apologize to the homeowner and the Edgefield community. I did not intend to steal anything or hurt anyone.” The defense claimed Mr. Smith thought the house was abandoned and he liked old houses and was in the process of planning to build a similar style of home.

Solicitor Maye said under the plea agreement Mr. Smith would enter a guilty plea to the charge of burglary in the second degree – nonviolent, and the weapons charges would be dropped in exchange.

Judge Keesley sentenced Mr. Smith to 15 years, suspended to service of four years in prison, and then an additional three years of probation. Smith was led from the courtroom where he spent a few minutes with his family before being taken back to the Detention Center where he will be transferred to the South Carolina Department of Corrections.

Smith will have to serve no less than one third of the four-year sentence (16 months) before being eligible for parole. He was given credit for nearly five months he has already served at the Edgefield County Detention Center awaiting trial.
