Son Charged with Assault for Defending Mother During Attack

web posted July 18, 2014

EDGEFIELD An 18-year-old Edgefield teen was charged with assault and battery in the third degree when he came to the aid of his mother who was being attacked by his father late Wednesday night. Even though the father and son were both charged in the incident, we are withholding their identities to protect the victim, and the son, in order to report the incident.

Edgefield County Dispatch got the call of the domestic disturbance just before 10:30 Wednesday night and deputies a few minutes later. Upon arrival they spoke to the father, who was "intoxicated", and claimed his son ran up behind him and attacked him for "no reason". The father had visible injuries to his mouth and forehead.

Deputies then spoke to the mother who said that she and her husband were having an argument that turned violent and he grabbed her around the next and pushed her down on the bed. "Right before (he) was about to hit her (the son) stepped in and pulled (the father) off her and struck him in the face area," an incident report said.

The mother and the son cooperated with the deputies and gave written statements. The father was too intoxicated to write a statement, the reported cited.

The father was arrested and charged with criminal domestic violence and transported to the Detention Center for booking until a warrant could be obtained.

The mother was provided with a "victim's sheet" explaining her rights and then the son was given a summons on the charge of assault and battery in the third degree for defending his mother from the attack. He was not booked into custody, but he will have to appear in Magistrate Court to defend against the criminal charge.
