Woman gets probation for burning baby’s body, hiding it under family home for months

EDGEFIELD – Just over two years ago Edgefield County Deputies were summoned to a home on the 500 block of Frances Street in June of 2006 with the discovery of the decomposing remains of an infant being found underneath the family home. As Sheriff’s Deputies, Investigators, and the Coroner arrived on the scene it was later discovered the daughter of the owners had placed the baby in garbage bags and then under the home while the rest of the family was away. Tomecca Tandrell Jackson, 22 at the time, claimed the baby was stillborn and she panicked. A later autopsy showed the baby tested positive for cocaine and the body had been burned before being placed in the garbage bags.

Ms Jackson was taken into custody and charged with felony desecration of human remains and was released on bond.

Due to the advance decomposition of the baby’s body police were unable to determine if the baby was stillborn, died after birth, due to the cocaine present in its system at birth, or died by other means.

According to reports at the time, Ms. Jackson had the baby in early April of 2006 while no one was at the home and that her parents were unaware of the pregnancy. During the delivery she claims she blacked out and when she regained consciousness, the baby was not breathing. Fearing no one would believe her she then tried to burn the baby’s body before placing it in the garbage bags.

Since her arrest Ms. Jackson has delivered a second child that also tested positive for cocaine and that baby was taken into the custody of the Department of Social Services where it remains in foster care officials said.

In court proceedings earlier this week Ms. Jackson plead guilty to the felony charge with no agreements or sentencing recommendations from the Solicitor’s Office. Circuit Judge C. J. Nicholson accepted Ms. Jackson’s guilty plea and asked Ms. Jackson what happened and why she did what she did. Ms. Jackson wept and would only say, “I held the baby and it wasn’t breathing”.

Judge Nicholson sentenced Jackson to five years of probation and gave her credit for the five days of time served before her release on bond. Under the conditions of probation Ms. Jackson, who stated she has been “clean” of drugs for six months, will have to pass weekly drug testing, attend substance abuse and family counseling, and will be eligible to have her second child returned to her in the near future.

The deceased child was said to be full term at the time of birth.

The sentence shocked many court observers as the SC Code of laws states anyone found guilty of the crime, “must be fined not more than five thousand dollars or imprisoned not less than one year nor more than ten years, or both.”
