Lawsuit may loom over Fox Creek School Board elections

MERRIWETHER – A candidate for the Fox
Creek School Board of Directors has obtained a lawyer and is
threatening legal action over the way the school board elections were
handled by the current administration. A Letter obtained by
EdgefieldDaily.com from attorney John Long to the Fox Creek School
Board lays out a complaint that states the elections held were improper
and seeks to have the results found to be “null and void”.
According to the paperwork obtained, Susie Stewart, a candidate for the
School Board contests the elections viability as it was allegedly done
outside of the guideline of the Charter School’s By-Laws.
The letter from Ms. Stewart’s attorney states, “I hereby demand that
you immediately strike the election results of May 14, and conduct a
new election in accordance with the applicable notice and voting
provisions set forth in accordance with the applicable notice and
voting provisions set forth in your bylaws and the laws of the State of
South Carolina.”
If Fox Creek does not comply, the letter states, “I will advise my
client to file suit against your Board in the Court of Common Please of
Edgefield County.”
The letter states that the elections held were “held in contrary to
your own bylaws.”
According to the letter the Fox Creek School Board did not provide a
slate of candidates, as required, prior to the May 11 meeting and the
candidates were not informed they would be on the ballot for election
and therefore had no time to conduct a campaign for election.
“By waiting until the week of the election, the candidates did not have
ample time to campaign, as evidenced by the mere 83 people out of
almost 350 turning out to vote, including faculty members. Furthermore,
upon information and belief, the ballot was not widely published nor
was proper notice given for parents of students to vote,” the letter
read.
The letter also requested that the five prequalified (unsuccessful
candidates) to be on the ballot be seated on the board.
The letter represents only one side of the matter and Fox Creek has not
answered the initial intent to file suit letter.
A copy of the letter was also sent to Edgefield County School District
Superintendent Mary Rice Crenshaw.
Ms. Stewart stated in an email that, “A 2-day campaign window for
something as important as BOD elections is suspect from the start, not
to mention that our May 31st YTD P&L showed a net loss in excess of
$168,000! Our monthly rent will go from $8,000/month (which
actually should be $9,600 because our lease expired) to a mortgage
payment of $25,000/month so how, you ask yourself, do they justify a
$60,000 computer screen sign?”
