Repeat offender given three years for sexual assault

Derwin Danielle Patten, 22, was arrested on July 20, 2005 and charged with several crimes including a probation violation, possession of drugs w/intent to distribute in the proximity of a school, criminal sexual conduct 3rd degree, manufacture/distribution of schedule l, ll, lll drugs with intent to distribute.

Judge William Keesley listened this week as the Assistant Solicitor read off the events that led to his arrest which included assaulting a woman and forcing her to have sex with him unwillingly. Mr. Patten was already on probation from a similar earlier June, 2002 attack.

Under a plea agreement the drug charges were dropped and the criminal sexual conduct charge was lowered to assault and battery of a high and aggravated nature, still a violent crime. Judge Keesley told Mr. Patten that as a “violent offender” he would have to serve tow-thirds of his sentence. Mr. Patten said he understood.

With that Judge Keesley sentenced Mr. Patten to ten years suspended to three years followed by five years probation. In addition he would have to pay $625 plus 3% and court costs as well as register as a sexual offender and give a DNA sample. He was given credit for time served while awaiting trial.
