House Passes Military Commissions Legislation Barrett: Bill Will Bring Terrorists to Justice web posted September 28, 2006 WASHINGTON DC – Congressman Gresham Barrett (SC, 3) voted Wednesday for H.R. 6166, the Military Commissions Act of 2006. The legislation will help create a system of justice for suspected terrorists that will protect our nation's intelligence capabilities while giving the suspected terrorists basic legal protections. The bill was approved in the U.S. House of Representatives by a vote of 253-168. The Military Commissions Act protects our military and intelligence personnel by codifying violations of Common Article 3 of the Geneva Convention. Currently, the article's vague provisions are open to a variety of interpretations, potentially rendering American personnel liable to prosecution without just cause. "My concern as we have moved through this process has been to protect American troops and American citizens from harm," continued Barrett. "The legislation we passed today preserves the ability of those on the front lines of this war to operate effectively against a new enemy on a new battlefield." H.R. 6166 establishes a system of military tribunals to try enemy combatants who have engaged in or supported terrorist activities. The act states that the substantive findings of classified evidence will be admissible in an unclassified form, but the classified evidence itself is protected and is privileged from disclosure to accused terrorists-as well as the panel of jurists-if the disclosure of the information would be detrimental to national security. "Our nation has captured hundreds of terrorists since Sept. 11, 2001, including masterminds of the 9/11 attacks and of other planned attacks on the United States and our citizens," Barrett said. "Until now, however, our country has lacked a way to bring these accused terrorists to justice. The Military Commissions Act provides a fair but efficient process for prosecuting terrorists that will protect sensitive intelligence while ensuring that terrorists have basic legal protections. These terrorists will now face the consequences of their actions." For
