Driver: “I’m too drunk to do field sobriety test”

JOHNSTON – A Johnston Police Officer on patrol early Saturday morning observed a car crossing over the railroad tracks on Lee Street and drifting off the road and then back onto the road. The car then drifted into the parking lot of the Shell Station and then “corrected really hard” to get back on the road. The officer continued to follow the car.

As the officer followed the car was “all over the road”, reports state, and the officer conducted a traffic stop to talk to the driver.

Upon approaching the car the officer reported an “odor of alcohol coming from inside the vehicle” and he asked the woman driving if she had been drinking. According to the incident report the woman stated she had.

The officer advised the woman of “implied consent” in order to do a field sobriety test, to which, according to the report, the woman stated, “F*** that, I am too drunk to do field sobriety test.” 

The officer then placed Kimberly L. Maddox, of Timothy Crossing in Merriwether, under arrest for public drunk. The official report stated that due to a large crowd at “the club” the officer felt he did not need to be at the jail long enough to perform the required testing for a DUI charge and the public drunk charge would be sufficient to remove an intoxicated driver from the road.

It may make Ms. Maddox feel better that the officer estimated her age in the report to be between 25 and 35 years of age. Ms. Maddox, it turns out, is 48.
