Clerk says town has not answered suit

JOHNSTON - Edgefield Daily.com received a copy of the four page lawsuit filed by Police Officer James David Willis against the Town of Johnston today. The lawsuit, filed in the Court of Common Pleas in the Eleventh Judicial Circuit was filed May 19, 2005 at 10:27 am in the Edgefield County Clerk of Court’s Office.

In the suit Willis alleges the town violated the Fair Labor Standards Act as well as the South Carolina Wage Payment Act and Breach of Contract. In the suit Willis charges that he did not receive compensation for over-time hours worked. He is represented in the suit by J. Charles Ormond, Jr. of the Holler Dennis Corbet Ormond & Garner firm of Columbia, SC.

However, we double checked with the Clerk of Court’s Office only to be told that the Town of Johnston has not filed an answer to the suit some 51 days later. The town is required to answer the suit, “within 30 days after service hereof, exclusive of the day of such service, and if you fail to answer within the prescribed time, a judgment by default will be rendered against you,” according to papers filed.

Mayor Dean Campbell has said he will not comment on the matter aside from the written statement offered earlier and Attorney Greg Anderson was not able to be reached at posting time. Edgefield Daily.com was also unable to reach Officer Willis for comment. We will follow up as details are available.

No records indicate any judgment being entered in the matter to date.
