EDGEFIELD – A Legal Notice for the Public
Sale of property at Mt. Vintage has been released. The sale is set for
September 8, 2009, at 11:00 am on the Edgefield County Courthouse
steps. The decree was granted in the case
of Carolina First Bank v. MV
Development Company, LLC, Bettis C. Rainsford and Talmadge Knight
(Civil Action No.: 2009-CP-19-24).

BY VIRTUE of a decree heretofore granted in the case of Carolina First
Bank v.
MV Development Company, LLC, Bettis C. Rainsford and Talmadge Knight
(Civil Action No.: 2009-CP-19-24), I, the undersigned, Special Referee
for Edgefield County has ordered that the following property, which is
the subject of the above action, be sold on Tuesday, September 8, 2009,
at eleven o’clock (11:00 am.), at 129 Courthouse Square, Edgefield
County Courthouse, Edgefield, South Carolina to the highest bidder:

All those certain pieces, parcels or lots of land, situate, lying and
being in the County of Edgefield, State of South Carolina, located
approximately ten (10) miles South of the Town of Edgefield, South
Carolina, and being shown and designated as Lots F-3 and F-4 on that
certain plat by Newby-Proctor and Associates dated April 8, 2003, and
recorded November 6, 2003, in the Office of the Clerk of Court for

All that certain piece, parcel, or tract of land, with all improvements
thereon, situate, lying and being within the County of Edgefield, State

containing sixty-six hundredths (.66) of an acre, more or less, and
designated as LOT P-3, on that certain plat prepared for MV Development
Company, LLC, by Newby-Proctor and Associates, and recorded in Judgment
Roll #38,150 in the Office of the Clerk of Court for Edgefield County,
South Carolina, which said plat is incorporated herein, and made a part
and parcel of this description as to the metes, bounds, and exact
location of the within conveyed property.

This being the identical property conveyed to MV Development Company,
LLC by deed of Ralph 3. Sapio dated January 28, 2008 and recorded in
the Office of the Clerk of Court for Edgefield County in Record Book
1166 at Page 338.
SUBJECT TO ASSESSMENTS, EDGEFIELD COUNTY TAXES, EXISTING EASEMENTS AND
RESTRICTIONS OF RECORD AND OTHER SENIOR ENCUMBRANCES.
TERMS OF SALE: The successful bidder, other than the plaintiff, will
deposit with the Special Referee at conclusion of the bidding, 5% of
his bid, in cash or equivalent, as evidenced in good faith, said to be
applied to purchase price in case of compliance, but to be forfeited
and applied first to costs and then to plaintiffs debt in case of
non-compliance. Should the last and highest bidder refuse to make the
required deposit at time of bid or comply with the other terms of the
bids within twenty (20) days, then the Special Referee may re-sell the
property on the same terms and conditions on some subsequent Sales Day
(at the risk of the said highest bidder).
Personal or deficiency being demanded, the bidding will remain open for
thirty (30) days but compliance with the bid may be made immediately-
Purchaser to pay for documentary stamps on Deed, if applicable. The
successful bidder will be required to pay interest in the amount of the
bid from the date of sale to the date of compliance with the bid at the
rate of 6.25% per annum as to Note A, 8.25% as to Note B and 6-00% as
to Note C.
Plaintiff may waive any of its rights prior to sale, including its
right to a deficiency judgment, in accordance with Rule 71 S,CRC.P. In
the event an agent of the plaintiff does not appear at the time of the
sale, the within property shall be withdrawn from sale and sold at the
next available sales day upon the tenns and conditions as set forth in
the Judgment of Foreclosure and Sale and supplemental order
