Jury trial goes haywire with visiting judge Short view Edgefielddaily.com web posted September 16, 2005 EDGEFIELD – Edgefield County Magistrate Court held a jury trial today, or at least tried to, on the matter of Dianne Ryan Vs Susan Presnell for harassment. Before the trial began a series of pre-trial motions were heard away from the jury pool on having Investigator Randy Doran removed from prosecuting the case. Lt. Doran stated he was instructed by Judge Parkman to prosecute the case. That motion was granted and Lt. Doran was removed from the state’s table. A second motion was to exclude Mrs. Ryan sole witness which was also granted. This left Mrs. Ryan very angry and having to represent the state in the trial. “I just don’t feel I am being treated right,” she said by having all her support taken from her right before the trial started. In her frustration she would make several comments and try to talk over Judge Williams, of Greenwood County. Judge Williams warned Mrs. Ryan such outbursts and statements would not be tolerated and that if she did it again she would be held in contempt of court. As the jury was seated again and the trial started Mrs. Ryan continued to let her frustration get the best of her and would make the statement she was at this trial against her will which resulted in the jury being removed and Mrs. Ryan being fined $50 or five days in jail. Mrs. Ryan was warned that any further outburst would result in her being removed from the courtroom. As the trial was attempted to begin again Mrs. Ryan again made similar statements and the trial was brought to a halt. Mrs. Ryan was fined a second time to $100 or ten days in jail, and the case was subsequently dismissed. Mrs. Ryan, being unable to pay the fine before leaving court was taken into custody by the Edgefield County Sheriff’s Deputies present. She was held until her husband could come pay her fines. Edgefield County Magistrate Brenda Carpenter said allowing a Sheriff’s Deputy to prosecute cases is normal and, “We are doing some checking,” to see how this ruling would affect future cases in the Magistrate Court. She preferred we speak with Judge Parkman on the particulars of this case as he was the Judge to instruct Investigator Doran to act on behalf of the state. Mrs. Ryan and Mrs. Presnell are neighbors and have had an ongoing feud for many years with numerous calls to police, legal filings, a restraining order, warrants, and trials scatter over the years. It is doubtful the outcome of this case will do anything but elevate the feud some with knowledge of the two said. Mrs. Ryan stated she was going to appeal the case with a court filing Friday.
