Threat of lawsuit over elections of Fox Creek School Board continues

MERRIWETHER – The threat of a lawsuit over
school board elections at Fox Creek Charter High School continues to
gain momentum as board of directors’ candidate Suzie Stewart continues
to call the election “invalid” and says her attorney calls it
“illegal”. As EdgefieldDaily.com
reported earlier this month, Stewart’s
attorney informed the Charter School they were in violation of their
own By-Laws in the way the election was conducted.
Mrs. Stewart said neither she nor her attorney has heard back from the
Fox Creek Charter High School concerning their challenge. “They just
deferred to the (Edgefield) County (School District) attorney, who is
Greg Anderson, and haven’t heard anything,” Mrs. Stewart said.
Attorney Greg Anderson represents the Edgefield County School District,
not the Fox Creek Charter High School, which operates as an independent
school under a 501(3) C which has their own board of directors and
their own legal representation. Mrs. Stewart said she was unsure of why
Mr. Anderson was involved in the matter other than Edgefield County
School Superintendent Dr. Mary Rice-Crenshaw was also sent a copy of
the letter challenging the election.
Mrs. Stewart said she spoke with Edgefield County School Board
Chairwoman Sallie Cooks at the Fox Creek graduation on June 4 about the
matter and Mrs. Cooks said she would follow up on the non-response from
the earlier communication the next day. “We’ve not heard anything
still,” Stewart said Monday.
A request has been filed to appear before the Fox Creek School Board at
their meeting this coming Monday, June 29, at 6 pm, by Mrs. Stewart,
though she said she fears they will deny her request to appear and
speak.
One important point of the election Stewart is focused on is, “If they
can’t follow their own rules, that they have written, I don’t know how
they expect us to entrust them to teach our children to follow rules.”
Mrs. Stewart said that the way the elections were held it, “denied a
lot of parents the right to vote. A lot of parents weren’t representing
in these elections at all.”
Mrs. Stewart also contends that Fox Creek Principal Tim Murph used his
position and authority to campaign against her.
Stewart said that if she is forced to file a lawsuit to resolve the
issue she would do so. “If I have to file a lawsuit I will certainly
file a lawsuit. I hate to have to do that because if I have to go to
that extreme,” Stewart said, “I’m going to focus on more than these
board elections.”
One such instance was a reference that former Edgefield County School
Board member Scott Chitty used his office as a Fox Creek School Board
member to campaign for his election to the County School Board. “He
(Chitty) made those phone calls to me from his office there at the
school asking me to do that (campaign)”, Stewart said.
If true, the activity would be in violation of Federal laws concerning
non-profit organizations being involved in general elections.
At this time the accusations made by Mrs. Stewart represent only one
side of the story and attempts are being made to obtain comments from
Fox Creek Charter High School, Edgefield County School District
Attorney Greg Anderson, and District Superintendent Dr. Crenshaw.
