No Charges to be Filed in Murphy Village Stabbing

web posted January 4, 2014

MURPHY VILLAGE In spite of the Edgefield County Sheriff's Office knowing the identity of the suspect, and even obtained a photo of him holding the large knife just prior to the stabbing, he will not be arrested or charged. Chief Investigator Randy Dorn told Edgefield Daily that the victim refuses to press charges in the case.

"We could go ahead and charge him," Doran said, "But the Solicitor's Office would throw it out because the victim is refusing to cooperate." Without a victim there is no crime.

As the investigation continued over the past week, one person arrived at the Sheriff's Office and had taken a picture of the suspect holding the knife on their cell phone. Investigators had already obtained the suspect's name during the investigation.

However, as the investigator in charge of the case continued to speak with the victim at the hospital, he questioned why it was going forward since he was not pressing charges on his attacker.

The investigation is, for the most part, stopped, although charges can still be brought at anytime in the future. There is no statute of limitations in South Carolina. The victim can, at anytime in the future, change his mind and the suspect - who has not been identified to the public - will be arrested and brought to trial.
