Edgefield County Probate Judge set to testify before South Carolina Judicial Committee

Edgefield County Probate Judge Robert Peeler is set to testify before the South Carolina Judicial Committee Thursday, April 26, 2005 to answer a complaint filed by Edgefield County Council Chairman Monroe Kneece.

Chairman Kneece filed a complaint, he says, as a citizen after the Edgefield County Council voted not to forward an issue advanced by County Administrator Wayne Adams involving Judge Peeler to state officials. Councilman Willie Bright correctly stated in the October 5, 2004 meeting that council has, “no jurisdiction over Judge Peeler,” and after heated council and community debate the matter fell with council voting not to forward the complaint.

The complaint was raised after Administrator Wayne Adams took Judge Peeler’s computer out of his office after he left for the day for over 45 days without a warrant and released what council found to be unfounded. Councilmen repeatedly stated at least two law enforcement agencies had reviewed the contents of the computer and found, "no criminal activity".

An anonymous source in county government with knowledge of the issue said there may be a problem with the complaint filed and the statements of Chairman Kneece. “The reply to Mr. Kneece referred to him as, ‘the honorable’ (Monroe Kneece),” suggesting the original complaint filed was as a county officer acting outside of the prevue of the council. Freedom of Information requests to the South Carolina Judicial Department requesting the complaint have not been responded to at this writing to confirm the claim. A source inside the Probate Court also said they too had seen the reference on official documents however.

Probate Court Judge Robert Peeler would not comment on the matter but did confirm he had met with his attorney several times and felt comfortable the inquiry would exonerate him. Judge Peeler had filed a Federal lawsuit against the county over the actions of Administrator Wayne Adams and sought a five million dollar settlement. The suit was settled later..

The results of the Judge Peeler’s hearing could be available as soon as Friday.
