Administrator's Office refuses access to public records

One of our staff members has been to the Edgefield County administrator’s office to review public records and has been refused access to those records, twice.

Clerk to Council Barbara Stark insists the Freedom of Information Act does not apply to anything other than the minutes to council meetings.
 
Requested were the records of costs associated with the offices of the Probate, Magistrate, and administration and the funds that have been expended in those moves.

Tracking public funds is exactly why the South Carolina Legislature passed, overwhelmingly, the law. Stark maintains any information requested must be in writing and the county has 15 days (excluding weekends and holidays) to reply as to if they will provide the records requested. That is factual on written requests. However the law also states, “Any person has a right to inspect or copy any public record of a public body, except as otherwise provided by SECTION  30-4-40, in accordance with reasonable rules concerning time and place of access”.

The county is in the process of the budget, the records we requested are no doubt easily accessible. We were appearing during normal business hours as prescribed by law and were willing to wait. Still our efforts were rebuffed. 

We will return again in effort to have our staff thrice denied.

The public and the press cannot be denied access to public records in their original form for review during regular business hours.
