Hilliard bond on murder charge set at $40,000

EDGEFIELD – Thomas Patrick Hilliard, 27,
of Johnston, who is charged with
murder in the death of 30-year-old
Phil (Trey) H. Herring lll last week, had a bond hearing before
Circuit
Court Judge Knox McMahon Wednesday afternoon. During the hearing a
tearful Mr. Hilliard struggled to wipe his eyes with tissues while
shackled as the proceeding took place. Three family members stood with
him as the murder charge was read.
Hilliard’s attorney Greg Seigler stated that Mr. Hilliard and the
victim, Mr. Herring, were friends and it was an unfortunate situation
that has lead to an unin+tended death. He stated Mr. Hilliard has long
stable ties to Johnston, was neither a flight risk nor a danger to
society and asked for a “reasonable surety bond.” Mr. Seigler stated
that Mr. Hilliard’s criminal past did not contain and violent crime.
According to the criminal history read at the hearing, Mr. Hilliard was
convicted of disorderly conduct April 13, 2000; burglary in the second
degree in November 10, 2005; disorderly conduct in November 29, 2007,
and has a pending charge is Saluda County. In Georgia Mr. Hilliard has
been convicted of possession of a controlled substance and interference
with police in September 9, 2005.
After taking all the information in Judge McMahon set Mr. Hilliard’s
bond at $40,000 and set forth conditions after his release. Mr.
Hilliard is to have no contact with the Herring family or the two women
who were present at the time of the incident, he will have to maintain
a specified residence set by the court, have a curfew of 8 am and 8 pm,
and will have to report to Johnston Police Investigator Lamaz Robinson
every Friday.
The family of Phil (Trey) Herring elected not to attend the hearing.
