Criminal Sexual Conduct trail moves into
second day of deliberations Edgefielddaily.com web posted October 14, 2005 EDGEFIELD – A criminal sexual conduct case involving a child under 11 got underway today in Edgefield. The man is accused of sexually molesting a then seven year old girl over a three year period. The girl, now 14, took the stand to recount the events as she remembered them taking place from 1999 to 2002. Rather emotionless she recounted what would otherwise be traumatic events in what the defense called a scripted testimony. She gave testimony of very descriptive abuses but offered little in definitive terms staying very general in her recollections which was understandable. After Sheriff’s Investigator Bledsoe testified the prosecution rested. The defense by attorney James Huff, of North Augusta, began putting several other family members on the stand who testified on behalf of the father. All testified to how close the two families were after which the defense rested. During closing arguments Mr. Huff asked for an immediate ruling of not guilty due to a complete lack of evidence of the states claims. Judge John Few refused his motion. Mr. Huff reiterated during his closing the complete and total lack of any physical evidence to support the allegations. Mr. Huff pointed out that the girl had been seen by three Doctors, none of which found evidence of sexual molestation. Assistant Solicitor Irvin May told the jury all the evidence they needed was sitting right in front of them, the young girl who was an eye witness to everything. Becoming somewhat emotional himself, Mr. Maye said the very person that the child was to “honor and obey destroyed that trust.” After closing arguments the state rested and Judge Few charged the jury and sent them to begin their deliberations just before 3:00 pm. The jury deliberated for the rest of the afternoon and sent word to the Judge later asking if their decision had to be unanimous which he confirmed a unanimous decision must be made by the jury. By 5:20 pm the jury again sent word to the Judge asking if they could continue their deliberations today. He granted their request and instructed them not to deliberate on their own during the night nor speak to anyone regarding the case. In addition he said they were not to do any research that could remotely be connected to the case, the charges, or any other similar cases. The jury will continue their deliberations beginning at 9:00am today.
