Surface Water Bill Demonstrates True Commitment to the Environment and
Economy

COLUMBIA – The SC House on Wednesday approved S.452 , the SC Surface Water
Withdrawal, Permitting, Use and Reporting Act. This bill
establishes a new surface water withdrawal permitting program at DHEC
and is the culmination of almost four years of intense negotiations
among industry, regulatory agencies, Farm Bureau, public water
suppliers, and the environmental conservation community. The bill
now goes to the Governor for signature before becoming law.
Under the legislation, a new permitting program at DHEC will be created
for surface water withdrawals of 3 million gallons per month or more
for industry and public water supply entities. A registration
process will be established for agriculture withdrawals of 3 million
gallons per month or more. Existing withdrawers in the state will
be permitted at their documentedhistorical withdrawal levels or at
their maximum design withdrawal capacity, whichever is greater.
Throughout this process industry and farming interests demonstrated
their commitment to this bill – particularly on the most contentious
element of the bill - minimum flow. Maintaining a certain minimum
water flow in rivers and streamswas the core issue in this debate and
the new permitting process will ensure that water withdrawal amounts
will be regulated in the future so as to protect the ecology of the
state's rivers and streams as well as those using this vital resource
for economic, municipal, agricultural, and recreational purposes.
Citizens for Sound Conservation applauded the passage of the
legislation that strikes a true balance between protecting the
environment and promoting industrial and agricultural operations and
future economic development. "It is yet another example of how
legislative and industry leaders continue to “roll up their sleeves”
working collaboratively to achieve an improved environmental and
economic quality of life for South Carolina."
