Stolen Gun Recovered Before Theft Reported

web posted February 4, 2014

WESTSIDE An Edgefield County Sheriff's Investigator was advised of someone who was in possession of possible stolen property and met with the man late Saturday. On Sunday Edgefield County Sheriff's Deputies were called to a report of an assault and battery complaint of Turkey Creek Road. Little did they know the cases were linked, leading to an arrest in both cases.

According to incident reports, the initial call came from a man stating his friend was in possession of what they believed was a stolen rifle. An Investigator met with the two men and he was given a Marlin 30-30 rifle. The man in possession of the gun said a friend asked for a ride to sell the gun and the unknown buyer backed out. At that time the suspect left the gun with the friend and asked him to sell it for him, a report states.

The rifle was seized, but had not been reported stolen at that time.

Less than 12 hours later on Sunday, Sheriff's Deputies were called to a disturbance at a home on Turkey Creek Road and when they arrived they found the homeowner stating he was assaulted by 25-year-old John Michael Miller after a confrontation about a stolen rifle. When deputies arrived the victim said he arrived home and found Miller going through his property in his bedroom and confronted him.

From there a physical altercation took place and the victim called 911.

When deputies discovered that the assault was in connection to a stolen rifle, the investigator was contacted about the incident. The investigator arrived later and the victim of the assault and the theft identified the rifle as his.

Miller was already being taken into custody for the assault when the investigator arrived and was informed he would be charged with the theft of the rifle, which he denied taking, according to a report.

The cases remain under investigation.
