Property Line Dispute Leads to Shooting of Dog

web posted October 23, 2012

WESTSIDE – A Garrett Road man and his son were marking their property line with surveyors tape Saturday afternoon when they were confronted by a neighbor. The neighbor stated the man and his son was on his property not their own. At one point the neighbor's Chow "became very aggressive" and charged the man's 6-year-old son, causing him to pull a pistol and shoot the dog six times to protect his son. The dog died from the wounds.

The son also stated the dog was charging him at the time his father shot the dog. According to the man, the neighbor then reached behind his back as if to pull his own weapon and the man then pointed his gun at the neighbor telling him to "show his hands and walk away", the incident report stated.

The neighbor did retreat to his home, but had a different story to tell the responding deputy.

According to the neighbor, the man and his son were on his property marking it as if it was theirs. He said he confronted the man who asked about the dog and was told the dog would not bother anyone and the man then pulled the gun and shot the dog and then pointed it at him, causing him to flee in fear of his life.

The deputy was shown where the incident took place and noted blood where the dog was first shot and leading to where he collapsed and died several yards away.

Neither man was able to provide any proof of where the property line was located. No charges have been filed at this time. Both men were given instructions on how they could take their case to the Magistrate Court.
