commission OK's zoning change for developer in Merriwether Edgefielddaily.com web posted April 15, 2005 Staff reporting Developer Jay Lacy returned to the planning commission to try once again to have property he bought in Merriwether rezoned from residential to light commercial. The property is located at the corner of Murrah Road and Martintown Road. The previous attempt, which went through the planning commission in the first months of 2003, was passed on for council’s review by the commission with a vote of 6-1, Bernadette Hudson, member at large being the sole objecting vote. Council did receive the matter and held a public hearing in which Lacy stood and told council he had the support of every neighboring property owner for his strip mall and grocery store and had a signed petition by them to allow him to continue. Oddly enough, one of the bordering property owners was present and stated he never signed any petition and was against Lacy’s plan. Others argued they were against zoning but that Lacy had pushed the idea and it was passed. He had then purchased property under those guidelines and knew the restrictions of the law he supported and just wanted it changed just for him. In the County Council meeting of April 1, 2003 the matter was brought up. After the review of the information revealed in the public hearing the matter died for lack of a motion. This prompted Mr. Lacy to state, “I assume that the lack of a motion of what I proposed as a project means that this project is dead.” To which Council Chairman Monroe Kneece replied, “yes”. Now Lacy is back, this time trying to piecemeal his original plan. By breaking up the final plan, which includes the strip mall and grocery store, he asked the planning commission to grant the change. By current zoning regulations such structures are not allowed. However, despite all the known plans of developer Jay Lacy by commission members, the public's disapproval, as well as the past council’s disapproval the planning commission voted 6-0 to allow the change to be passed on to county council. Planning commission member Bernadette Hudson was not present at the meeting. County Council will probably take the measure up at their next meeting on May 3, 2005, and possibly set a time and date for the required public hearing. Return to
